Terms of use

These terms govern your use of ozwebnet.com and the Insights journal at ozwebnet.com/insights, operated by SEYYED PTY LTD (ABN 74 685 427 801), trading as Ozwebnet ("we", "us"). By using the site you agree to them. They do not replace the written quote and agreement that governs any project we undertake for you; that is explained below.

What these terms cover

They cover browsing the site, reading and subscribing to the Insights journal, and using the contact page, which composes an email in your own mail app — nothing is sent to us from the site itself. Nothing on the site is an offer to provide services on fixed terms; a project begins only when a written quote is accepted.

Using the site

You may use the site for lawful purposes. You must not attempt to interfere with its operation or security, scrape it in a way that burdens it, or use it to send unsolicited communications. We may restrict access where these terms are breached.

Intellectual property

The design, code, text, imagery, renders and the Ozwebnet name and emblem on this site are owned by us, created for us, or used under licence. You may view the site and quote short extracts with attribution, but you may not copy, reproduce or reuse its design, code or imagery without our written permission. Nothing in this clause limits any use permitted under the Copyright Act 1968 (Cth), such as fair dealing for research, study, criticism, review or reporting news. Trade marks belonging to others remain theirs. The source code we write for clients is handed to them with the intellectual property assigned, as set out in their agreement — that is separate from the code of this site.

Accuracy of content

We take care to keep the site accurate and up to date, and we make no claims about our work that we cannot stand behind: figures shown about this site are measured live in your browser, and we do not publish client work, testimonials, ratings or awards. Descriptions of services are general; the scope of any project is defined only by its written specification and quote.

The site may link to other websites. We are not responsible for their content or their handling of your information. The Insights journal runs on Ghost software; posts express our views at the time of writing and are not professional advice for your situation.

Subscribing to Insights

Subscribing to the Insights journal is free. When you subscribe, Ghost creates a member record for the email address you give and we send you new posts by email. You can unsubscribe using the link in any email or by writing to [email protected], and we may change or end the newsletter at any time. How subscriber details are handled is explained in our privacy policy.

Consumer guarantees and liability

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

The site and the Insights journal are provided free of charge, for general information. To the extent permitted by law, we are not liable for loss or damage that arises because the site is unavailable, interrupted or contains an error, or from reliance on general information on it, and we are not liable for indirect or consequential loss arising from use of the site. This clause is about the site only. The liability terms that apply to a development engagement are set out in the written agreement for that engagement, not here.

Development engagements

A project is governed by its written specification, the fixed quote staged against milestones, and the written agreement that accompanies them — not by these terms. The agreement provides that: the price is fixed, and changes only if the specification is varied in writing and the variation is priced and agreed before it is built; each milestone ends with a working system; you may stop at the end of any milestone, pay for the milestones delivered, and keep what has been delivered; and the intellectual property in the code we write for you is assigned to you in writing on payment of the milestone in which that code was delivered. Third-party and open-source components used in a build remain under their own licences and are identified at handover. Quotes are in Australian dollars. Ozwebnet is not registered for GST (ABN Lookup, September 2026), so no GST is added to a quote. If that changes, GST will be shown as a separate line on the quote. Hosting, domains and third-party services are held in your own accounts and billed to you by their providers.

Privacy

Our privacy policy explains what personal information we collect through the site and the Insights journal, and how we handle it. It forms part of these terms.

Governing law

These terms are governed by the laws in force in South Australia, and you submit to the non-exclusive jurisdiction of the courts of South Australia. If any part of these terms is void or unenforceable, that part is severed and the rest continues to apply.

Changes

We may update these terms from time to time. The effective date at the top of the page is the date of the current version. If we make a material change we will note it on this page and, for Insights subscribers, mention it in the next email. Changes apply to your use of the site from the effective date; they do not change the terms of any engagement agreement already in place.
